Welcome to name.krd (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of the website http://name.krd (the “Site”) and the services we provide (together, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Definitions

  • “Buyer” means any user who browses listings or contacts Sellers to purchase assets.

  • “Seller” means any user who lists assets (domains, phone numbers, car plates, business names, or VIP items) for sale.

  • “Listing Package” means one of the paid tiers that Sellers must purchase to post or renew listings.

  • “Assets” means the digital or high-value items traded on name.krd, including but not limited to .krd domains, rare phone numbers, car plates, VIP items, and business names.

  • “Verified Seller Badge” means the designation granted to Sellers who submit verification documents and are approved by name.krd.

2. Eligibility

  1. You must be at least 18 years old to register.

  2. By registering, you represent that you are legally capable of entering into binding contracts.

3. Account Registration & Security

  1. Sign-Up: You may register as a Buyer or Seller using your email plus OTP via WhatsApp or by using Google Sign-In.

  2. Accuracy: You agree to provide accurate, current, and complete information.

  3. Security: You are responsible for safeguarding your password and account. Notify us immediately of any unauthorized use.

4. Listing Packages & Payments

  1. Purchase Required: Sellers must purchase a Listing Package before creating or renewing a listing.

  2. Fixed Fees: All Listing Packages are non-refundable and priced as displayed on the Site.

  3. Payment Processing: We facilitate payments only for Listing Packages. Asset transactions occur directly between Buyers and Sellers off-site.

5. Listing Rules & Removal

  1. Compliance: All listings must accurately describe the Asset and comply with our Listing Guidelines.

  2. Prohibited Content: No illegal, fraudulent, or infringing items may be listed.

  3. Removal Rights: We reserve the right to remove or suspend any listing or account that violates these Terms, our Policies, or applicable law.

6. Communication & Chat

  1. Platform Use: Buyers and Sellers may communicate via our built-in chat tool. We do not monitor private messages but reserve the right to investigate reports of abuse.

  2. Respect & Conduct: You agree not to harass, defame, or threaten other users.

7. Verified Seller Badge

  1. Application: Eligible Sellers may submit documents to apply for a Verified Seller Badge.

  2. Revocation: We may revoke badges at our discretion for policy violations or fraud.

8. Intellectual Property

  1. Site Content: All content on name.krd (text, graphics, logos) is owned or licensed by name.krd and protected by copyright, trademark, and other laws.

  2. User Content: You grant us a non-exclusive, worldwide, royalty-free license to use any content you submit (e.g., listings, messages) to operate and promote the Services.

9. Disclaimers & Limitation of Liability

  1. No Warranty: The Site and Services are provided “as is” and “as available,” without warranty of any kind.

  2. Transaction Disclaimer: We do not guarantee the quality, legality, or safety of any Asset or transaction. Buyers and Sellers transact at their own risk.

  3. Limitation: To the maximum extent permitted by law, name.krd and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site or Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless name.krd, its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Termination

  1. By You: You may delete your account at any time via account settings.

  2. By Us: We may suspend or terminate your access for violations of these Terms or for any other reason at our sole discretion.

  3. Effect: Upon termination, your license to use the Services ends, but accrued rights and obligations survive.

12. Changes to Terms

We may modify these Terms at any time. We will post the most recent version on the Site and update the “Last updated” date. Continued use after changes constitutes acceptance.

13. Governing Law & Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of the Kurdistan Region, Iraq, without regard to conflict-of-law principles.

  2. Dispute Resolution: Any dispute will be resolved through good-faith negotiations. If unresolved within 30 days, either party may bring the matter to the courts of Erbil, Kurdistan.
